Description

An examination of selected domestic and international issues in immigration and refugee law.

This course provides an introduction to immigration and refugee law in New Zealand, with particular focus on the Immigration Act 2009.  The course will cover the basic features of the 2009 Act, with approximately half the course spent considering immigration issues and the other half of the course on refugee law.

The immigration component of the course is likely to include the following topics: citizenship, visas (including temporary and residence visas), turnaround at the airport, and deportation.  The role of immigration instructions will also be examined.

The refugee component of the course will review the international protections available under the Refugee Convention, and the associated protections under the Convention Against Torture and the International Covenant on Civil and Political Rights; and their domestic equivalents - refugee status and the new protected person status in New Zealand.

Learning Outcomes

  • The aim of this course is to provide a comprehensive introduction to the field of immigration and refugee law in New Zealand.  The learning outcomes are:
  •  familiarity with the general contours of immigration and refugee law in New Zealand;
  •  knowledge of New Zealand’s international human rights obligations in the context of immigration and refugee law;
  •  knowledge of the Immigration Act 2009 as the key framework for immigration and refugee issues in New Zealand;
  •  knowledge of the role and jurisprudence of the Immigration and Protection Tribunal and its predecessors.

The assessment in the course may consist of an essay, an optional book review and an end of course assessment (to be advised).  The assessment will be confirmed in the first week of lectures.
