Description

An introduction to intellectual property law in New Zealand, including copyright, registered trade marks, passing off, and patents.

Intellectual property law is concerned with legal rights that may be asserted with respect to products of the human intellect.  Intellectual property can have both cultural and economic significance.  Accordingly, the creation of intellectual property is often rewarded by granting the owner a degree of exclusive control over commercial exploitation.
Given the extent of intellectual property law and the single-semester length of this course, the course will provide an introduction to several aspects of intellectual property law in New Zealand, including copyright, registered trade marks, passing off and patents. Students will examine and analyse relevant statutory and case law, as well as real-world examples from legal practice and the entertainment industry. In order to give students an opportunity to develop and practise higher-level legal-analytical skills, selected aspects (such as copyright law) will be studied and assessed in greater depth.
(Students should note that the two-hour lecture will be the regular weekly lecture. The one-hour lecture will be used for lectures or practice exercises during some, but not all, weeks. Recommended reading information will be available on the Learn page for the course.)

Learning Outcomes

  • On successful completion of this course, students should be able to:

  • Describe and explain selected principles of intellectual property law;

  • Identify the legal sources of these principles;

  • Identify and critically analyse intellectual property issues in relevant factual situations;

  • Apply the law to such issues;

  • Further develop skills such as legal analysis and critical reasoning.
