Description

The course involves a detailed study of the law relating to personal securities, as well as associated topics such as credit contracts.

Personal Property Securities & Credit covers two major areas of commercial law. Credits are an important part of our economy and as such frequently used. However, lenders face the risk that the borrower will not or cannot repay their credits. They therefore frequently secure their loans against some or all of the borrowers personal property. This course explores the rules around both credits and personal property securities and how these concepts interact. It also takes a critical view on whether consumers are adequately protected and whether future reform is desirable.

As the course coordinator, it is important to me that I can successfully stimulate your interest in this field. Personal property securities and credit contracts are very important areas if you want to work in a commercial law firm, and it is much easier for you to learn and understand the topics if you are interested in them.

To this end, I strive to demonstrate the relevance of these areas of law through every-day examples. I also conduct the lectures in an interactive manner and keep you involved in the teaching and learning process. The assessments of the course are geared towards your future role in a commercial law firm.

Learning Outcomes

  • This course will enable you to:

  •  acquire knowledge and understanding of selected principles of the law governing credit contracts and security interests over personal property;
  •  understand and apply those principles to particular situations;
  •  consider critically issues of principle and policy raised by the present law and its operation and practice and consequently, whether reform is desirable; and
  •  further develop skills in legal analysis and reasoning.
